CMC Response to Civil Justice Council Consultation on AI and Court Documents

The Civil Mediation Council has submitted a response to the Civil Justice Council’s consultation on the Use of AI for Preparing Court Documents.

As mediation becomes increasingly embedded within the civil justice system, the CMC continues to engage with policy discussions that shape how disputes are resolved in practice. This includes considering how developments such as AI may affect both court proceedings and mediation processes.

The CMC’s consultation response highlights the overlap between materials prepared for court and those used in mediation, noting that documents such as chronologies, case summaries and lists of issues are often shared across both. In this regard, consistency of approach is important to ensure a coherent and user-friendly system.

The response also raises considerations around the use of AI-powered tools in negotiations and mediation, particularly where such tools are used to predict outcomes. It emphasises the importance of transparency, including the need to disclose the use of AI, to support effective discussion and informed decision-making.
