Lady Chief Justice: Mediation After the Singapore Convention
The Lady Chief Justice delivered a significant speech to the British Institute of International and Comparative Law this week, highlighting the evolving role of mediation in dispute resolution in light of the Singapore Convention.
Emphasising the importance of the rule of law, she discussed the potential for the Singapore Convention to enhance global legal frameworks while fostering cooperation between litigation, arbitration, and mediation. Her insights reinforce the need for legal advancements to meet the demands of an increasingly interconnected world.
Kelly Stricklin-Coutinho, Chair of the CMC, commented: “Mediation working together with litigation and arbitration is essential to supporting the full development of England and Wales as a leading global centre for dispute resolution. It will lead to better outcomes for parties to those disputes, both domestically and internationally.”
In her lecture Baroness Carr highlighted how the CMC and other bodies are already performing essential functions, such as maintaining professional and ethical standards for mediators. She also suggested that its scope might need to be broadened to align with the growing demands of international mediation.
